Airfare, Transportation & Hotel
Winning songwriters will each receive One (1) roundtrip airfare ticket to a live Elliot Root show. Round-trip airfare must be to and from major cities in the continental US. Transportation to and from the destination city/airport and hotel will be provided. Hotel will be for a 2-night stay. Songsinc will escort winners during their visit.
Winning Songwriter PRIZE OPTION: In lieu of trip/airfare and hotel, winner may opt to receive $500 US Dollars.
Recording of Winning Songs: Winning songwriters agree that Elliot Root and their producer may re-work the winning submissions as they feel necessary for final recording of the digital single/album single.
Agreed Shares/Splits of winning Songs
Original Song: The Songwriter of the winning original song will split publishing 50/50 with Elliot Root publisher. If the band feels some additional co-writing changes need to be made to the winning original song, the winning songwriter agrees to those changes and will split writer's share 50/50 with the band. If no melodic/lyrical changes are made, original songwriter will retain 100% writer share.
Track2Song: The songwriter of the winning Track2Song agrees to a 50/50 co-write ownership split with the band.
OFFICIAL CONTEST TERMS & CONDITIONS
ELIGIBILITY: This Songsinc PRO Artist Elliot Root Songwriting Contest is open to Songsinc and Broadjam Members worldwide who are 18 years of age or older. This contest is Void where prohibited.
HOW TO ENTER: Your Contest fee will allow you to enter an original song and/or a Track2Song created with the Elliot Root Instrumental Track. Your Song submission format must be MP3. Contest begins (October 7, 2011). All entries must be received by (January 22nd, 2012). You may create multiply melodies and lyrics using the Elliot Root Instrumental Track and may enter as often as you like, but each entry must be a unique MP3. Subsequent entries of the same MP3 Original or Track2Song entries throughout the Contest will be disqualified.
ENTRY REQUIREMENTS: All entries must meet the following guidelines:
The entry and all elements of the Original Song and Track2Song melody & Lyric must be the entrant’s original work.
The entry must not violate the intellectual property rights of any third party.
The MP3 entries must be suitable for publication and publicity purposes as determined by Broadjam and Songsinc in their sole discretion. Lyrics must be in good taste and must not contain obscene or defamatory statements nor portray Broadjam, Songsinc or any third party in any way that might tend to subject them to public contempt, scandal, disrepute or ridicule.
Entrant acknowledges that Broadjam and/or Songsinc may promote and highlight any MP3 and entrant without any compensation to entrant, singers or persons used in the creation of the New Song MP3, in any and all media, throughout the world, in perpetuity.
Entrant agrees any singer or performer used on the New Song Demo MP3 submission (singer, musician, producer, studio, engineer, etc.) did so as a Work for Hire (with signed copy on file) and has no claims whatsoever to any prize money, publicity, contractual agreement, royalties or compensation, and each understands and agrees they will NOT be identified in any publicity, marketing or promotion.
Songsinc and Broadjam reserves the right to make determinations of suitability in their sole and absolute discretion and to disqualify any entries it determines to be inappropriate for any of the reasons listed above, or for any other reason.
Songwriters creating new songs (melodies & lyrics) with the Elliot Root instrumental track retain 100% ownership of their new song (melody & lyric) but have no rights whatsoever to the Elliot Root instrumental track outside of this opportunity and for the sole purpose of using the instrumental track to create a new song with it for entry into this contest. Any other use will be a violation of copyright. Any new song created with this instrumental track may NOT be exploited outside of this contest with the written permission of Elliot Root and management.
POSTING OF ENTRIES: All eligible Contest entries (as determined by Broadjam and Songsinc in their sole discretion) may be posted on the publicly accessible Contest, Broadjam and Songsinc web sites, to include but no be limited to Facebook, Twitter, MySpace, YouTube.com and similar sites.
JUDGING CRITERIA: Eligible entries will go through the Broadjam Song Peer Review System as well as Songsinc A&R system. One entry will be Winner in each category, for a total of 2 winning songs. The ratings are final and may not be appealed.
WINNER SELECTION/PRIZE AWARDING: On or about (February 27th, 2012) the winners will be selected and will be notified via e-mail and/or phone. Winners must sign and return an Affidavit of eligibility and Publicity and rights Release, and the personal releases of any co-writer within seven (7) days of attempted delivery or prize will be forfeited. If any prize/prize notification is returned as undeliverable, or in the event of non-compliance with any other requirements, the prize will be forfeited in its entirety and may be awarded to an alternate. Winner agrees that receiving a prize grants Broadjam and/or Songsinc the right to print, publish, broadcast, and use universe-wide in any media now known or later developed at any time or times, the winner's name, portrait, picture, voice, likeness, and biographical information for any purpose, including but not limited to, in advertisements, publicity, and other communications without additional compensation, except where prohibited by law. Odds of winning depend on the number of entries received.
PRIZES: Two (2) First Place Category Winners and One (1) Grand Prize: (Both winning songwriters will be flown to a meet/greet with the band and will attend a live show at a location to be determined. Both winning songs will be recorded by the band and released as digital singles, and both songs will be performed at the live show. Of the two winning songs, one grand prize winner will be selected. The grand prize song will also be included on the band's next album - Tentative Spring 2012 release - as well as placed into their touring playlist.
RIGHTS IN SUBMISSIONS: In consideration of entrant’s submission, entrant grants Broadjam and/or Songsinc the right, but not the obligation, to use the song MP3 and name and likeness of entrant, in a commercial or other advertising and publicity for Broadjam and/or Songsinc. Track2Song entrants: In connection with your Melody & Lyric, you agree that you will not submit any Melody and/or Lyric that is copyrighted, protected by trade secret, or is otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to submit the material and enter the Contest and to grant Broadjam and/or Songsinc of all the license rights granted herein. To obtain permission from third parties such as co-writers from appearing in the entry, a legal release form, available by clicking here, can be used.
GENERAL RULES: Void where prohibited. All federal, state, country and local laws apply. All income taxes resulting from acceptance of prize are the responsibility of winner. By entering contest, entrant accepts and agrees to these Official Rules and the decisions of Judges, which shall be final in all matters. By participating in this contest and/or accepting prizes, entrants agree to hold Broadjam, Songsinc and its affiliates, directors, officers, employees and assigns harmless against any and all claims and liability in connection with the contest, the videos, or the use or redemption of prizes, including, without limitation, bodily injury or death or the violation of the rights of any third parties. Submission of contest entry (1) constitutes permission to use winners’ names and likenesses, address (city/state), and MP3 entry, for advertising and publicity purposes without further compensation, unless prohibited by law. Broadjam and/or Songsinc and its affiliated companies will not be responsible for lost, late, or misdirected entries or prize notices or for any typographical, or other error in the administration of the contest, or announcement of the prize. In the event of any such error, Sponsor reserves the right to request that the Judges modify this contest in a manner deemed reasonable by the Judges, at the Judges’ sole discretion. Neither Broadjam nor Songsinc are responsible for late, lost, illegible, incomplete, stolen, garbled or misdirected entries, all of which are void. Electronic entries will be deemed made by the authorized account holder of the e-mail address submitted at time of entry. The authorized account holder is deemed as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries that are incomplete, illegible or corrupted are void and will not be accepted. By entering the Contest, entrant recognizes and agrees that the registration information provided by entrant will be made available to Broadjam and Songsinc; use of such information will be governed by Sponsor’s privacy policy found on each site (http:www.broadjam.com and www.songsinc.com). Broadjam and/or Songsinc have the right, in their sole discretion, to disqualify any individual who tampers with the entry process, and terminate, suspend, cancel or modify the Contest and award the prizes from among all eligible entries received as of the date of termination if for any reason this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, fraud, unauthorized intervention, technical failures or other causes beyond the control of Sponsor.
